Project Overview

The Hopkins Correctional Centre located in Ararat, Victoria is a medium security prison which was expanded under a PPP arrangement to include a range of new facilities, including a new 358-bed medium security prison to increase the prison’s overall capacity to over 740 prisoners. Aegis Correctional Partnership Pty Ltd (Aegis) entered into an agreement with the State to finance, design, construct and maintain the Works. In 2013 Brookfield Multiplex Constructions Pty Ltd (BMC) entered into a Managing Contractor Agreement with Aegis to complete the Works. However, issues occurred during the course of completing the Works, which resulted in significant delays in achieving Commercial Acceptance.

 

TBH’s Role

TBH was engaged by Herbert Smith Freehills (HSF) on behalf of Aegis to prepare an independent Expert Report detailing the opinions in relation to delays claimed by BMC while completing the works. This required the preparation of an alternative analysis to demonstrate the cause of delays.

 

The TBH Difference 

Through detailed analysis of all the information available on the project, TBH was able to firstly understand the issues on the project and subsequently via the preparation of an Expert Report break down the complexity surrounding the issues and provide a clearer picture of the delays that occurred on the project. TBH’s advice and independent report was used to successfully achieve a settlement between Aegis and BMC.
